        How do I determine the value of a drowning accident claim?

        When we have represented families that have been involved in drowning accidents, one of the questions that they often ask is, “What can we ask for in terms of compensation?” It’s important to understand that there is no amount of money that will compensate a family for losing a child, a brother, a wife or a husband, or a parent. There is no amount of money that can make them whole, so to speak.

        In order for us, then, to determine what the reasonable settlement value is, we have to follow Texas law and look at the different elements that we can ask for under that law. For example, if the drowning victim suffered prior to their death – for example, they knew that they were drowning – their estate is entitled to compensation for that. Also, the family members, such as a parent, spouse or child, are entitled to be compensated as well. If a husband or wife drowns and there’s a loss of income to the family, they’re entitled to ask for that income as part of their compensation. That can be a lifetime of income if the person is a younger person, for example.

        Also, you have mental anguish and emotional distress that you can ask to be compensated for. This includes the suffering that you have experienced as a result of the drowning, as well as loss of affection, loss of love, loss of companionship. All those things that have been taken from you as a result of the drowning are elements of compensation that you can ask for.
