        How long is a drowning accident case going to take?

        Answer:

        A few years ago, we represented a family whose child drowned in an apartment complex swimming pool. One of the questions that the family asked at the outset was, “How long is this going to take?” There is no simple answer to that question. In that particular case, the apartment complex denied responsibility. They blamed the child, claiming that the child had climbed over the fence that was around the pool.

        We did a very thorough investigation. We interviewed tenants and other witnesses that were in the area at the time. We talked to the maintenance people that work for the apartment complex, and we subpoenaed some records and such. Through that process, we were able to prove that the lock on the gate had actually not been properly secured by the maintenance personnel the day before. The child had therefore been able to open the gate and then fell into the pool and drowned.

        In that particular case, the apartment complex then changed their position and accepted responsibility, and we were able to resolve that case fairly quickly. However, if the apartment complex had not changed their position and had insisted that it was not their responsibility or their fault, then a trial might have been necessary and might have taken longer.
