        Question:

Who is liable for my truck accident injury claim?

        Answer:

If you are involved in a truck accident where you or a loved one has been harmed, hurt, or even killed by an 18-wheeler, for example, there are several potential parties that can be liable to you under the law. First of all, the driver, the driver who made the mistake, who caused the crash, can be held liable. The company, the trucking company, can be held liable. If the trucking company just bought brand new tires from a tire shop and it turns out those tires were defective and that’s why the truck lost control, then the tire company or the tire shop can also be held liable. The good news is that in the United States in order for you to transport goods, you have to have a DOT number. You have to be approved by the federal government to transport goods from one state to another.

In order to get that DOT number, you have to prove that you have a valid insurance in place to protect the public should your truck driver cause any harm or should something happen to your truck, like a blown tire, cause harm to the public. It’s not just the public. It includes damage to the roadways, damage to public property. There has to be insurance in place. Any time that you have been involved in a crash with an 18-wheeler, there will be insurance there to protect you and will allow you to recover compensation for any harm that’s befallen you. Even though we talk about what parties are we going to go after, is it going to be the driver, is it going to be the truck company, is it going to be the tire shop, is it going to be the tire manufacturer, regardless of who’s responsible, there will be insurance there to protect you and allow you to recover for the harm that’s fallen you and your family.
