        What is a dram shop claim?

        Answer:

        First of all, in order to sell alcohol, the bar or restaurant has to have a license from the state. What comes with that license are certain requirements that they meet to protect the public from people getting drunk at their establishment and then causing havoc on the streets after driving home drunk. In order for the bar or restaurant to get that alcohol service license, they have to meet these criteria. If the bar or restaurant doesn’t meet those criteria, and as a result, a drunk person is served alcohol at their establishment, someone who’s obviously intoxicated, and they leave that bar or restaurant in that state and hurt someone or kill someone, the bar is legally responsible for that. Many bars and restaurants, the responsible bars and restaurants, will comply very strictly with these requirements. If they feel that they’ve made a mistake and they have overserved someone, they will make arrangements for that person to be taken home, either via Uber or some other means, and not let them get in their car and drive. If you have a bar or restaurant that overserves somebody, violated the rules, and didn’t protect the public from that person who has become intoxicated, they should be liable, and it’s my job to prove that they are liable.
